A Practical Step for Restoring Civil Society

In the late ‘80s I moved from a quiet and homogenous part of the country to attend a university in Louisiana. Needing money I began working the evening shift at Kinko’s Copies, in downtown New Orleans. I was in for a shock.

I witnessed many disturbing crimes - including armed robbery. In another incident a man whose throat had been cut – ear to ear – stumbled into the store begging for help. I told him the ambulance was coming, he then weakly raised his arm, extending his open hand, and said, “God bless you”, and then he fainted from blood loss.

But watching a man defecate in the street shocked my middle class sensibilities the most:  he yanked his trousers off, squatted, and then, appeared to wipe himself with his own bare hand; I stood stunned as I watched this.

Years later while reading a biography of President Theodore Roosevelt the subject of public defecation arose in the context of 1898 war against Spain. Noticing widespread incidence of public defecation the U.S. military governor of newly liberated Cuba resolved to end this disgrace. Orders were issued to summarily horsewhip anyone caught shitting in the streets. Havana quickly became a model for public sanitation.

After reading the biography there appeared the curious story of young Mr. Fay. He was the young man caught vandalizing cars in Singapore and as punishment he received a caning from Singaporean authorities.

Does corporal punishment work? I think so. I noted that Mr. Fay quickly left Singapore after the administration of justice and he has not been heard from since. I am confident he will never again vandalize cars in Singapore.

If whippings don’t “work” does psychotherapy, counseling, incarceration, anger management, rehabilitation, or any other Enlightenment derived “criminal justice” theory “work”?

Objections.

Perhaps Mr. Fay chose to be whipped instead of rotting in some Asian dungeon and suffering the ‘peculiar desires’ of the local homosexuals? The justice Mr. Fay received also might be tainted with revenge; doubtless many in Asia must have relished the whipping of a white man at the hands of an Asian.

Still even in the decadent West the religious faith of therapeutic reform is - slowly - waning. Modern versions of more ancient forms of punishment are returning: ankle bracelets, think stocks and pillories; community orders, think public humiliation; and victim reparations, think ‘eye for an eye’.

I would argue these forms of punishment are moving towards the acceptance of corporal punishment, and not away from it.  They are unquestionably reactions against the expensive folly of therapeutic “reformation of the heart” doctrine - think reformation of the butt.

Consider the old German punishments; for example, stoning (the sagas already have millstones drop on the head of the guilty), breaking on the wheel (the most characteristic invention and speciality of the German genius in the realm of punishment!), piercing with stakes, tearing apart or trampling by horses (“quartering”), boiling of the criminal in oil or wine (still employed in the fourteenth and fifteenth centuries), the popular flaying alive (“cutting straps”), cutting flesh from the chest, and also the practice of smearing the wrongdoer with honey and leaving him in the blazing sun for the flies. With the aid of such images and procedures one finally remembers five or six “I will not’s,” in regard to which one had given one’s promise so as to participate in the advantages of society—and it was indeed with the aid of this kind of memory that one at last came “to reason”!

The punishments you list, above, I would only apply to elected officials.

I think the boiling in oil and flaying would be especially useful in deterring abuse of the taxpayer’s munificence.
