They courted prosecution, and duly succeeded. As a consequence, nationalism has been denied two talented writers. It’s possible, of course, that there could be a Niemöller moment in it, as an ideologically totalitarian structure picks off the easy ones ... the ones no one will defend. Will we see the discussion of human difference, especially cognitive difference, classified as hate speech? Or the existence of Jewish ethnic interests? Whatever happened to that ridiculously proscriptive set of “anti-anti-semitic” proposals that emerged in the US a year or so ago? Equally, where has the attempt to export German self-flagellation by making an “offence” in one can country prosecutable in another got to now? 4
Posted by Guessedworker on July 16, 2008, 06:43 PM | # onetwothree, I am sure it will have been taken down, but the “offending” material was originally here:- I bet the prosecution couldn’t find anyone to stand up in the witness box and describe how he or she was, in fact, moved by it to hate our elder brothers in faith. There was no hate produced in the real world. But prosecuting counsel has only to prove that the material was “likely to incite hatred”. So the whole thing becomes just a debate about what was in the readers’ minds, which no man can know. It is, therefore, an exercise in moral interpolation - wrong in principle for that reason, and wrong in fact because, as we all know, the objective of nationalist literature is to awaken one’s own people, not to induce them to blunder towards illegality and unproductiveness. That said, the two heretics made it easy for the prosecutor. I just don’t see why. 5

We don’t want British criminals, particuarly these odious examples of the breed. Welcoming those whose anti-social activity has been sanctioned in their own country would be worse than a couple run of the mill illegal immigrants from south of the border, as well as setting a terrible precedent. 8

Whittle, 41, of Avenham Lane, was convicted of penning anti-Jewish articles on a website, but he failed to turn up at Leeds Crown Court on Monday for a hearing. US immigration officials detained unemployed Whittle when he arrived at Los Angeles airport on Tuesday to claim political asylum. Whittle is being held in Santa Ana City Jail, near LA, while he awaits an asylum hearing. The jail has more modern accommodation than most of the state’s ageing jails and education programmes to help inmates reform. It is a type II jail, which is at the lower end of security. Inmates are allowed three visits a week. It houses people arrested in the Santa Ana area, adults and youths awaiting trial, and parolees. Whittle is likely to have his case considered at an immigration hearing in the US before UK authorities can secure his return. American immigration expert Alex Rojas has warned Whittle is unlikely to be soaking up the sunshine in Hollywood while waiting for his case to be heard by a judge. Mr Rojas, a partner in New York legal firm Barst and Mukamal, said: “It could be anywhere between three to six months before a case is scheduled for hearing. Typically, he would be kept in custody. “Under no circumstances would he be permitted to obtain any permit to work while an application is pending.” California is known for its harsh sentencing, high re-offending rates and having America’s most over-crowded prisons, with up to three inmates per cell. One jail had to convert a gym into extra cells for inmates at risk of being beaten up over drug debts or by notorious gangs who clash over race. A sign above the entrance of California State Prison reads: “The purpose of prison is punishment.” Mr Rojas reckons Whittle’s bid for asylum is unlikely to succeed and he could face up to a year in jail in Britain if convicted of absconding. Mr Rojas said: “It is very difficult to get political asylum from the UK. You have to establish a well-founded fear of persecution based on race, religion, nationality or membership of a particular social group or political opinion.” 16

Note the comments of Alex Rojas in the article, above. Is he their attorney? What both men need is an unapologetic attorney who will do his homework on American asylum precedent established with other persecuted writers, starting with Alexander I. Solzhenitsyn if not earlier. Solzhenitsyn was admitted under political asylum. 19

Luke’s an excellent blogger and Simon, while eccentric, is obviously an intelligent fellow. I presume they’ve quite deliberately aimed to gain maximum publicity for themselves in order to highlight the free speech issue, rather than submit to getting silently locked up. Then again, maybe they just dropped everything and fled. I can’t really blame them. 21

That misleading and slyly crafted mantra has been used to silence debate and vilify opposition for almost four decades. If so there are a hell of a lot of them to tolerate. What of the large number of Muslims who believe that homosexuals should be executed, or those who believe that women are inferior and that their husbands have the right to beat them?, I certainly am not going to tolerate that, however, politically incorrect that may make me. The vast majority of gang rapes are perpetrated by blacks or Asians, Viva la difference, and recent figures demonstrate that black youths are 13 times more likely than whites to commit knife crime, yet these are even more differences we are forced to tolerate, and really expected not mention. This command that we tolerate difference which is waved in our faces as if it were holy writ, has been used in order to change our nation, and huge swathes of Europe beyond recognition, without ever submitting the campaign to democracy. It is in itself a weapon of intolerance of any contrary view or any opposition. Another thing, what do mean when you spoke about “screaming abuse”? who screamed abuse? The two men who are applying for political asylum in America were not convicted of screaming anything. They wrote words and expressed written opinions, as free men have through out the ages, that was their crime. However, in your argument you refer to that as “screaming abuse”, because, as ever with those who argue as you do, you can only win by misrepresenting the opposition. 24

The other gentleman incarcerated with him, Mr. Whittle, who writes commentary under the pen name Luke O’Farrell, I don’t know well, having scarcely read his material. Of course I support both of them one-thousand percent in this matter. Anyone who doesn’t is ... well, GW would like the emotion toned down a bit around here, so I won’t finish that sentence. I remember Whittle made a bit of an ass of himself a few months ago in a comment thread at Sean Gabb’s site. Nevertheless, I’m surprised there’s been no press release or mention of it on the LA’s blog. If the LA is prepared to defend Gary Glitter surely it should at least comment on the Sheppard/Whittle affair. 29

But you’re right: why did these two guys who are supposed to be well-infomed choose California to flee to????? (It’s conceivable they weren’t that well informed and didn’t realize how far the situation over here has deteriorated.) Moscow, Venezuela, and Iran would have been viable choices politically but as for earning a living there, who knows? 35

I wish these two well, but they may have made a mistake in coming to the U.S. Remember, Germar Rudolph was living quietly with his wife and baby daughter in Chicago when he was snapped up during a routine visit to the INS and shipped off to Germany. He’s now in prison there. And Ernst Zündel was living quietly in Tennessee with his wife, running a small art gallery, when a team of police and immigration agents swooped down on him at his home and carted him away to Canada. After several months in solitary, he was shipped off to Germany, where he’s now in prison.
