Contrary to reports that Simon Sheppard and Steve Whittle had jumped bail to live on a beach in Thailand, the truth has now emerged as to their exact whereabouts: Sheppard and Whittle are being held by the INS (the American Immigration and Naturalization Service) at LAX (Los Angeles International Airport) after claiming political asylum on arrival. Help from local comrades is being organised in terms of solidarity, and legal advice.

TWO men convicted of publishing race-hate articles on the internet have skipped bail and fled to the United States to claim political asylum, the Yorkshire Post can reveal. Simon Sheppard and Stephen Whittle were given bail by a judge at Leeds Crown Court on Friday, despite having been found guilty of a series of race-related offences. The pair were due to return to court on Monday while a jury continued deliberating over further charges, but they failed to show up. Last night Sheppard, 51, and Whittle, 41, were being held by immigration officials at Los Angeles Airport ? outside the jurisdiction of the British court system…..

I wish these two well, but they may have made a mistake in coming to the U.S. Remember, Germar Rudolph was living quietly with his wife and baby daughter in Chicago when he was snapped up during a routine visit to the INS and shipped off to Germany. He’s now in prison there. And Ernst Zündel was living quietly in Tennessee with his wife, running a small art gallery, when a team of police and immigration agents swooped down on him at his home and carted him away to Canada. After several months in solitary, he was shipped off to Germany, where he’s now in prison.

Sheppard and O’Farrell went about things in a deliberately provocative way.  Presumeably, that was how they wanted it.  They courted prosecution, and duly succeeded.  As a consequence, nationalism has been denied two talented writers.

It’s possible, of course, that there could be a Niemöller moment in it, as an ideologically totalitarian structure picks off the easy ones ... the ones no one will defend.  Will we see the discussion of human difference, especially cognitive difference, classified as hate speech?  Or the existence of Jewish ethnic interests?  Whatever happened to that ridiculously proscriptive set of “anti-anti-semitic” proposals that emerged in the US a year or so ago?  Equally, where has the attempt to export German self-flagellation by making an “offence” in one can country prosecutable in another got to now?

I bet the prosecution couldn’t find anyone to stand up in the witness box and describe how he or she was, in fact, moved by it to hate our elder brothers in faith.  There was no hate produced in the real world.  But prosecuting counsel has only to prove that the material was “likely to incite hatred”.  So the whole thing becomes just a debate about what was in the readers’ minds, which no man can know.  It is, therefore, an exercise in moral interpolation - wrong in principle for that reason, and wrong in fact because, as we all know, the objective of nationalist literature is to awaken one’s own people, not to induce them to blunder towards illegality and unproductiveness.

That said, the two heretics made it easy for the prosecutor.  I just don’t see why.

If the American public were polled, well over 99% of them would prefer not to have these two immigrants in our country, shouldn’t the majority get their way? We don’t want British criminals, particuarly these odious examples of the breed. Welcoming those whose anti-social activity has been sanctioned in their own country would be worse than a couple run of the mill illegal immigrants from south of the border, as well as setting a terrible precedent.

Thanks for the link to the Heretical website.  I was previously unaware of it. Maybe Sheppard and Whittle should have landed in one of the white colonies in Orange County.  I know of a beach house in Laguna Beach they could have holed up in for a while.

Asylum racist facing LA prison ‘Porridge’

A racist Preston writer who fled to the apparent safe haven of Los Angeles could be set for a hairy few months - after being banged up in prison.

Whittle, 41, of Avenham Lane, was convicted of penning anti-Jewish articles on a website, but he failed to turn up at Leeds Crown Court on Monday for a hearing.

US immigration officials detained unemployed Whittle when he arrived at Los Angeles airport on Tuesday to claim political asylum.

Whittle is being held in Santa Ana City Jail, near LA, while he awaits an asylum hearing.

The jail has more modern accommodation than most of the state’s ageing jails and education programmes to help inmates reform.

It is a type II jail, which is at the lower end of security. Inmates are allowed three visits a week.

It houses people arrested in the Santa Ana area, adults and youths awaiting trial, and parolees.

Whittle is likely to have his case considered at an immigration hearing in the US before UK authorities can secure his return.

American immigration expert Alex Rojas has warned Whittle is unlikely to be soaking up the sunshine in Hollywood while waiting for his case to be heard by a judge.

Mr Rojas, a partner in New York legal firm Barst and Mukamal, said: “It could be anywhere between three to six months before a case is scheduled for hearing. Typically, he would be kept in custody.

“Under no circumstances would he be permitted to obtain any permit to work while an application is pending.”

California is known for its harsh sentencing, high re-offending rates and having America’s most over-crowded prisons, with up to three inmates per cell.

One jail had to convert a gym into extra cells for inmates at risk of being beaten up over drug debts or by notorious gangs who clash over race.

A sign above the entrance of California State Prison reads: “The purpose of prison is punishment.”

Mr Rojas reckons Whittle’s bid for asylum is unlikely to succeed and he could face up to a year in jail in Britain if convicted of absconding.

Mr Rojas said: “It is very difficult to get political asylum from the UK. You have to establish a well-founded fear of persecution based on race, religion, nationality or membership of a particular social group or political opinion.”

Sheppard and Whittle’s coming to the United States was either an uninformed decision made on their own or the result of amateurish advice back in England.  Note the comments of Alex Rojas in the article, above.  Is he their attorney?  What both men need is an unapologetic attorney who will do his homework on American asylum precedent established with other persecuted writers, starting with Alexander I. Solzhenitsyn if not earlier.  Solzhenitsyn was admitted under political asylum.

I don’t think the Heretical.com material will be taken down (I hope not) — after all, it’s hosted in the USA, which was Sheppard’s defense regarding its supposed contravention of UK law. Luke’s an excellent blogger and Simon, while eccentric, is obviously an intelligent fellow. I presume they’ve quite deliberately aimed to gain maximum publicity for themselves in order to highlight the free speech issue, rather than submit to getting silently locked up. Then again, maybe they just dropped everything and fled. I can’t really blame them.

The problem is, the Weimar Republic had [hate speech laws]. It used them freely against the Nazis. Far from stopping Hitler, they only made his day when he became Chancellor. They enabled Hitler to confront Social Democratic Party chairman Otto Wels, who stood up in the Reichstag to protest Nazi suspension of civil liberties, with a quotation from the poet Friedrich Schiller:

Ah! but of course, those words “tolerate difference” the chant of the new oppression. That misleading and slyly crafted mantra has been used to silence debate and vilify opposition for almost four decades. It, and similar phrases like it, have been used to intimidate and vilify anyone who does not embrace the new orthodoxy in order to transform half of Europe without ever putting your imposed orthodoxy to any popular vote.

No political party in any Western nation has ever fought an election on a mandate of increased multiculturalism or diversity, they impose it by deceit and using dishonest tactics such as accusing their opponents of spreading hate and “intolerance of difference”.

Of course tolerance of difference is only allowed in respect of imposed difference, but I guess that may be because there is so much more to tolerate. Which is just one of the reasons why such phrases are so dishonest.

Consider what you are saying for a moment,must we tolerate all difference, or just approved and pretty ones? murderers are different, do we tolerate them?, rapists are different, and mostly imported (check the statistics!) are we supposed to tolerate them as well? In terms of different cultures, women who mutilate their daughter’s genitals are different, so are parents who force their daughters into forced marriages, or brutalise and murder them on account of “honour”, are they to be tolerated? If so there are a hell of a lot of them to tolerate.

What of the large number of Muslims who believe that homosexuals should be executed, or those who believe that women are inferior and that their husbands have the right to beat them?, I certainly am not going to tolerate that, however, politically incorrect that may make me.

The vast majority of gang rapes are perpetrated by blacks or Asians, Viva la difference, and recent figures demonstrate that black youths are 13 times more likely than whites to commit knife crime, yet these are even more differences we are forced to tolerate, and really expected not mention.

This command that we tolerate difference which is waved in our faces as if it were holy writ, has been used in order to change our nation, and huge swathes of Europe beyond recognition, without ever submitting the campaign to democracy. It is in itself a weapon of intolerance of any contrary view or any opposition.

Another thing, what do mean when you spoke about “screaming abuse”? who screamed abuse? The two men who are applying for political asylum in America were not convicted of screaming anything. They wrote words and expressed written opinions, as free men have through out the ages, that was their crime.

However, in your argument you refer to that as “screaming abuse”, because, as ever with those who argue as you do, you can only win by misrepresenting the opposition.

1st August 2008

Dear Mr. Covington:

Many thanks for the material you have sent, and especially for your offer to help us settle in the Northwest if our asylum request is granted. At present we are severely hampered in countless ways. For example, we have cash in our baggage, but no money for sending letters in our prison account. Our address books are in our baggage to which we do not have access, and even getting paper and a proper pen is difficult. Because of these difficulties could I ask you to please send a photocopy of this letter, so that my friends know what’s going on, to [the names and addresses of all Airstrip One residents will be redacted to avoid retaliation by the Zionists. - HAC]

As this is the last letter I am able to send without having funds in my prison (commissary) account, please can your forward an extra letter for [redacted] who kindly wrote, offering help. Fortunately I have her address, while a previous correspondent, Charlie K. of Seattle, offered to help, but the prison mail room has a policy of removing stamps and stick-on labels, i.e. return address labels, with the result that I can’t contact him. If you know his address, please let me know.

Now as to your letter proper. Of course I know who you are. Indeed, there is some of your writing on the Heretical site—“Feminist Seize Control Of Publishing”, if I remember correctly. Also, you were an associate of the late, great Robert Frenz, whose site I now maintain as a legacy.

Regardless of your scheme for a White Homeland in the Northwest, it has been evident that the Northwest is an attractive destination for White Nationalists. Indeed I once received a visit in England from a chap from Portland, Matt Downey, whom I would like to look up, given the opportunity.

Our destination of LA/California was largely symbolic, as Torrance is where the Heretical web site is based. We have since learned that our convictions in England are solely for web pages emanating from Torrance, and on the legal ground that they are “available” in England and Wales it would be quite possible for an American visiting England to be prosecuted on the same grounds—maximum sentence under this iniquitous, Jewish law is seven years. (Increased from two to seven in 2000.)

The facility in which we are held is fairly relaxed, and the biggest problem is boredom. We can receive publications but they are supposed to be direct from the publisher, or an orthodox source like that. Still, we received the Instaurations and glossy magazines. I foresee no difficulty in sending your Northwest novels, which I would be interested to read.

We are being held (I understand) on two grounds; firstly the visa waiver which we had to fill out in order to board the plane, plus a reciprocal arrangement with Great Britain that each will detain the others’ fugitives. This latter is irrespective of the offence. Looking over some papers last night it became clear we have successfully overcome the first hurdle in our claim for asylum—the officials could have marked our claim “not credible” immediately, had they so desired. Several of the officials have been openly supportive.

I’m led to understand that an asylum claim can take around three months, and assuming our applications are successful I would be very happy to take up your offer of assistance in the Northwest. [I think I’d better redact that section as well, just in case. - HAC]

In closing, then, thank you once again for your letters and envelopes, and please let me have your comments on the above. Your support is much appreciated.

Whatever his flaws may be, I consider Simon Sheppard a brilliant commentator.  The other gentleman incarcerated with him, Mr. Whittle, who writes commentary under the pen name Luke O’Farrell, I don’t know well, having scarcely read his material.  Of course I support both of them one-thousand percent in this matter.  Anyone who doesn’t is ... well, GW would like the emotion toned down a bit around here, so I won’t finish that sentence.  But use your imagination.

I’m somewhat surprised that this case has not been noticed by the Libertarian Alliance. I remember Whittle made a bit of an ass of himself a few months ago in a comment thread at Sean Gabb’s site. Nevertheless, I’m surprised there’s been no press release or mention of it on the LA’s blog. If the LA is prepared to defend Gary Glitter surely it should at least comment on the Sheppard/Whittle affair.

Why did it take so RIDICULOUSLY LONG for that rejection decision to be handed down?  Clearly they wanted Sheppard’s and Whittle’s return to England in “right-wing disgrace” to come just in time to maximize its propaganda effect in swaying voters against the BNP in the June elections.  Anyone think the exact, couldn’t-be-more-perfect timing on this has been coincidence?  I don’t.

Not Argentina — you saw how quickly Bishop Williamson was kicked out of there:  Jewish interests in Argentina are obviously well-guarded.  But you’re right:  why did these two guys who are supposed to be well-infomed choose California to flee to?????  (It’s conceivable they weren’t that well informed and didn’t realize how far the situation over here has deteriorated.)  Moscow, Venezuela, and Iran would have been viable choices politically but as for earning a living there, who knows?
