SOUTH AFRICA’s government has begun seizing land from white farmers, targeting two game farms in the northern province of Limpopo after talks with the owners to buy the properties collapsed.

Johannesburg-based newspaper City Press reported owners Akkerland Boerdery wanted 200 million rand (£16.7m) for the land, but that the country’s government were willing to offer them just a tenth of that at 20 million rand (£1.67m).

A letter sent to the owners earlier this year had said: “Notice is hereby given that a terrain inspection will be held on the farms on April 5, 2018 at 10am in order to conduct an audit of the assets and a handover of the farm’s keys to the state.”

Akkerland Boerdery immediately took out an urgent injunction to prevent eviction until a court had ruled on the issue, but the Department of Rural Development and Land Affairs has refused the application.

Annelie Crosby, spokeswoman for the agricultural industry association AgriSA, told City Press: “What makes the Akkerland case unique is that they apparently were not given the opportunity to first dispute the claim in court, as the law requires.”

ANC spokesman ZiZi Kodwa refused to reveal details of the farms being targeted and has attempted to cal investor fears, adding the proposed seizures were “tied to addressing the injustices of the past”.

He told City Press: “Over time I think the markets as well as investors will appreciate that what we are doing is creating policy certainty and creating the conditions for future investment.”

Tensions among South Africa’s white farming community has been escalating since the election of Cyril Ramaphosa as President earlier the year, who committed his African National Congress (ANC) to land expropriation.

Last week, ANC chairman Gwede Mantashe sparked panic among the farming community when he said: “You shouldn’t own more than 25,000 acres of land.

“Therefore if you own more it should be taken without compensation.”

“People who are privileged never give away privilege as a matter of a gift.

“And that is why we say, to give you the tools, revisit the constitution so that you have a legal tool to do it.”

A record number of white South African farmers have put their land up for sale amid fears the ruling party is considering confiscating properties bigger than 25,000 acres.

The government was accused of drawing up a list of almost 200 farms it allegedly wants to seize from white farmers, with AfriForum, a civil rights group representing the white Afrikaner minority, adding the document was being circulated by ministers as the ruling powers prepare to implement the policy.

South Africa’s High Court rejected a legal challenge today brought by a group representing white farmers against President Cyril Ramaphosa’s plans for land expropriation without compensation.

No one is coming to save us. Even the documents are ancestors created to govern us and our posterity will fail in the end.

Land is a hot-button issue in South Africa where racial inequality remains entrenched more than two decades after the end of apartheid when millions of the black majority were dispossessed of their land by a white minority.

Ramaphosa, who replaced scandal-plagued Jacob Zuma in February, has made land redistribution a flagship policy as he seeks to unite the fractured ruling African National Congress (ANC) and win public support ahead of an election next year.

In its legal challenge, Afriforum questioned the legality of a key parliamentary committee report which recommended a change to the constitution to allow land expropriation without compensation.

‘The relief sought by the applicants… is dismissed,’ said Judge Vincent Saldanha.

Afriforum, which represents mostly white Afrikaners, alleged that the parliamentary committee had illegally appointed an external service provider to compile the report, and also failed to consider more than 100,000 submissions opposing land expropriation without compensation.

Around 65 percent of public submissions were against a change, according to parliamentary officials.

Parliament successfully countered Afriforum’s case by saying the court action was premature, the committee had not abrogated its powers and all views had been taken into account.

‘We welcome the orders handed down today particularly because we’ve always been of the view that the matter was not urgent,’

Lewis Nzimande, co-chair of the constitutional review committee, told reporters outside the High Court in Cape Town.

‘They [lawmakers] may set aside the recommendations, they may reject the recommendations but procedurally… we can’t just reject the whole work of the committee,’ he said.

He said the report, just one step in a long process to change the constitution, will probably be debated in both houses of parliament on December 4.

Thereafter, it is expected a new bill proposing the exact changes envisaged to the constitution will go to parliament and further public participation.

Only once both houses of parliament approve changes to the constitution will it be sent to Ramaphosa for ratification. 

This process is unlikely to be completed before a parliamentary election expected to be held in May.

Afriforum said after the judgement they would continue challenging what they say is a flawed process, including through further legal action.

‘AfriForum therefore undertakes to use every possible mechanism at its disposal to, in the interest of everyone in the country, fight to the bitter end against the undermining of property rights,’ it said in a statement.

Nearly a quarter of a century after the end of white-minority rule, white South Africans comprise just eight per cent of the population but still hold most of the individually owned private land.

This disparity keeps most of the economic power in the hands of a few and makes the country one of the most unequal societies in the world.

In July President Cyril Ramaphosa said the ANC planned to amend the constitution to allow for expropriation without compensation, sparking concerns that the move could destabilise the fragile economy and spur conflict in an already socially divided nation.

A month later US President Donald Trump waded into the controversy by tweeting - incorrectly - that South Africa had begun seizing farms and that high numbers of farmers were being killed.

No one is coming to save us.

No one is coming to deprive us of the same fate as the white South Africans.

We must decide if we wish to survive.

We must decide if we wish to thrive.

For our posterity, we must.

There is no getting off this ride. Democracy is nothing more than a racial headcount, and where the USA is headed, the soon-to-be white minority will inevitably share the same powerless, futureless fate as the white South Africans now confront.

White-owned property in South Africa’s cities and towns will be seized along with white farms in order to provide “high-density housing” for blacks, and whites are to blame for the country’s collapsing train services, South African President Cyril Ramaphosa has announced.

Addressing a meeting of “traditional leaders” in the Cape Town City Hall on Wednesday this week, as part of the ANC’s election campaign, Ramaphosa also blamed Apartheid [read whites] for African backwardness and the fact that blacks are always poor.

“Land in cities and towns must be identified for seizure without compensation upon which high-density housing can be developed so that ordinary South Africans can live close to their places of work,”  Ramaphosa told the meeting.

“Apartheid distributed people outside of the major cities. The poor lived outside the cities, and the rich inside them,” he continued.

“Just like other world cities, South Africa had to develop high-density housing in the city and town centers, and the government was going to use the seizure of land without compensation program to identity suitable land within the urban areas.

“This is going to reduce the living costs of the poor who will then not have to travel so far to their places of work,” he said.

This is the first open confirmation that it is not just farms which are going to be seized under the “no compensation” rules scheduled to be introduced in March 2019, but also white properties in urban areas.

Ramaphosa went on to blame whites for the collapsing railway infrastructure in South Africa, even though the ANC has ruled the country for the last 25 years.

He acknowledged that the public transport infrastructure was very poor and that it cost the South African economy dearly. He undertook to “pull the Passenger Rail Agency of South Africa (PRASA) right” after a new series of criminal corruption scandals recently shook the state-owned rail transportation system.

“Some train stations in the townships [the black suburbs] are closed. People do not use them anymore because of crime and the unreliability of the train system,” Ramaphosa told the meeting, adding that this too was due to the “heritage of apartheid [read whites] which left us with poor public transport systems.”
