Police told to treat Muslims differently Feminism is not quite the force it once was here in Victoria. Still, it has a powerful friend in the Attorney-General, Rob Hulls. Mr Hulls believes that there is an entrenched bias against women in the law and he has set about rectifying it. In particular he believes that an outmoded, misogynistic legal system has sheltered men who commit acts of domestic violence. So he has enacted a variety of legal reforms, including giving police the immediate power to detain a man accused of domestic violence for six hours. Given all this, it was a surprise to read the following in the Melbourne Herald Sun: “Police are being advised to treat Muslim domestic violence cases differently out of respect for Islamic traditions and habits. “Officers are also being urged to work with Muslim leaders, who will try to keep the families together.” The local Islamic women’s groups aren’t happy with the new police guidelines. Ms El Matrah of the Islamic Women’s Welfare Council called the guidelines appalling and dangerous and complained that “The implication is that one needs to be more tolerant of violence against Muslim women ...” But she can complain all she likes - the reality is that multiculturalism has trumped feminism. The police are being told that: “In incidents such as domestic violence, police need to have an understanding of the traditions, ways of life and habits of Muslims” and that it would be appreciated in cases of domestic violence if police consult the local Muslim religious leader who will work against “fragmenting the family unit”. So there seem now to be two systems for dealing with accusations of domestic violence. In the first, the emphasis is on removing the man accused of an act of domestic violence, even before guilt or innocence has been determined. In the second, designed for the multicultural other, police will tread carefully and even call in local religious leaders to try to keep the family together. Nor is this the only “culturally sensitive” guideline issued to the police. There is an entire 82 page book of them, including that Baha’i suspects should only be interviewed after sunset in the fasting month; and that Sikhs may not be disturbed during the reading of the Sikh Holy Script (which can take 50 hours). They can work all day long against ‘fragmenting the family unit’(1 male,4 wives)but Koranic approval for divorce is underscored by the ease with which it is effected - simply recite ‘Talak’three times to the spouse whose presence is no longer required.
